Departments of Labor, Health and Human Services, Treasury announce proposed rules to strengthen Mental Health Parity and Addiction Equity Act
Under the Consolidated Appropriations Act, 2021, the Tri-Agencies are required to review no fewer than 20 non-quantitative treatment limitation (NQTL) comparative analyses and report the results of these reviews to Congress on an annual basis. The first annual report was published on January 25, 2022, and the second report was published on July 25, 2023. The reports detail the enforcement actions taken by the Tri-Agencies as it relates to the Mental Health Parity and Addiction Equity Act (MHPAEA). The reports note widespread deficiencies in the comparative analyses submitted by health plans, and a majority of the initial analyses submitted by plans were found to be insufficient. ER is proud to work with our federal partners to perform these reviews and deliver important results improving access to mental health and substance use disorder treatment. Details of the trends, violations, and corrective actions related to these reviews are detailed in the reports linked below.
