On February 20, 2026, the Tri-Agencies released the 2025 MHPAEA Report to Congress, the fourth annual report detailing the results of reviews and investigations related to 120 non-quantitative treatment limitation (NQTL) comparative analyses and compliance with the Mental Health Parity and Addiction Equity Act (MHPAEA). Although there are continued deficiencies in the comparative analyses provided by health plans and challenges in obtaining sufficient information to demonstrate compliance, the report also shows improvements that expanded access to care for millions of people. The report highlights findings and corrective actions across more than 39,000 health plans, improving MH/SUD benefits for 18+ million participants, including expanded access to opioid use disorder treatment, autism services, and eating disorder care. Our dedicated NQTL team at Examination Resources is proud to support these advances. In collaboration with our partners at CMS, our team’s analysis and findings resulted in stronger NQTL comparative analyses, compliant utilization management practices, removal of outdated exclusions, better network standards, and more equitable access to behavioral health care. Details of the trends, violations, and corrective actions related to these reviews are detailed in the report linked below.
